Asset Protection Attorney in Long Beach, CA

Shield your estate from creditors, lawsuits, and bad outcomes. Serving Long Beach and surrounding communities.

Protecting What You Have Built

Asset protection is about putting legal structures in place before something bad happens. Lawsuits, creditor claims, business liabilities, divorce, and long-term care costs can all wipe out decades of work. Planning ahead puts barriers between your assets and people who might try to take them.

The key word is “ahead.” Asset protection only works if it is done before a claim exists. Transferring assets after you are sued is a fraudulent transfer and the courts will unwind it. We help Long Beach families and business owners plan early.

What We Handle

California Asset Protection Rules

California does not recognize domestic asset protection trusts (DAPTs) under its own law. You cannot put assets in a California trust for yourself and shield them from your creditors. But you can use DAPTs formed in other states, and you can use other tools — LLCs, irrevocable trusts, and retirement accounts — that do work in California.

California has a homestead exemption that protects a portion of your primary residence from creditors. As of 2024 the exemption is at least $361,113 — and can be higher in Long Beach and other high-cost areas. Combining the homestead with other planning can protect most or all of the equity in a family home.

Retirement accounts (401(k), IRA) are generally protected from creditors under state and federal law. So are properly structured life insurance policies and annuities. We use these alongside trusts and entities to build layered protection.

Who Should Plan for Asset Protection

Asset protection planning is especially important if:

Our Process

Step 1: Risk Assessment

We identify where your real exposure is and what assets need protection most.

Step 2: Layered Plan

We design a plan using trusts, entities, and exemptions that fit your specific situation.

Step 3: Implement & Monitor

We put the structures in place and review them regularly as your situation changes.

Asset Protection Questions

No. Transfers made after a claim exists are considered fraudulent and can be unwound by the court. Asset protection has to be planned before any claim is on the horizon.

An LLC protects your personal assets from claims against the business, and — if structured right — can protect business assets from claims against you personally. It is not bulletproof. Proper formation, funding, and record-keeping matter.

Mostly, yes. 401(k)s and employer retirement plans have strong federal protection. IRAs are protected under California law, though the protection is capped. We coordinate retirement accounts into the overall plan.

Offshore trusts can work for the right client, but they are expensive, complicated, and invite IRS scrutiny. Most California families do not need them. Domestic tools usually provide enough protection at a fraction of the cost.

A basic LLC and homestead strategy can cost a few thousand dollars. Costs vary depending on your situation. The cost is tiny compared to losing the assets.
